Infringement Complaint
1. Introduction
This Online Streaming Platform Infringement Policy ("Policy") outlines the procedures and measures implemented by Ztor.com ("the Platform") to address copyright infringement claims, in compliance with the Copyright Ordinance (Cap. 528) of Hong Kong. The Platform respects intellectual property rights and expects its users to do the same.
2. Prohibited Conduct
Users are prohibited from uploading, posting, transmitting, or sharing any content that infringes upon the copyright of any third party. Such actions violate this Policy and may result in the removal of the infringing content and/or termination of the user's account.
3. Notice and Takedown Procedure
In accordance with the Copyright (Amendment) Ordinance 2022, the Platform has established a notice and takedown procedure to address allegations of copyright infringement. Upon receipt of a valid notice of alleged infringement from a copyright owner or an authorised representative, or once independently made aware of the infringement, the Platform will take reasonable steps to limit or stop the infringement as soon as practicable.
4. Submitting a Notice of Alleged Infringement
To submit a notice of alleged infringement, the copyright owner or authorised representative must provide the following information:
A physical or electronic signature of the copyright owner or authorised representative.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material alleged to be infringing, including information reasonably sufficient to enable the Platform to locate the material.
Contact information of the complaining party, including postal address, telephone number, and email address.
A declaration from the complainant indicating a genuine belief that the material is being used in an unauthorised way by the copyright owner or their representative law.
A declaration affirming that the notice information is accurate and that, under penalty of perjury, the complaining party has the authority to act on behalf of the copyright holder owner.
5. Counter-Notice Procedure
If a user believes their content was mistakenly removed or wrongly identified, they can submit a counter-notice to the Platform. The counter-notice must include:
The user's physical or electronic signature.
Identification of the material that has been removed or had its access disabled, and the location of the same.
A declaration, made under penalty of perjury, asserting that the user genuinely believes the material was removed or disabled following an error or misidentification.
The user's name, postal address, telephone number, and email address.
A statement that the user consents to the jurisdiction of the courts of Hong Kong for the purpose of any legal proceedings arising from the counter-notice.
6. Repeat Infringers
The Platform reserves the right to terminate user accounts that are subject to multiple copyright infringement claims, in accordance with the Copyright Ordinance.
7. Limitation of Liability
The Platform's liability for copyright infringements occurring on its service is limited, provided that it takes reasonable steps to limit or stop the infringement upon receipt of a valid notice or upon becoming aware of the infringement.
8. Amendments
The Platform reserves the right to amend this Policy at any time. Users are encouraged to review this Policy periodically to stay informed of any changes.
